Terms and Conditions

These Terms & Conditions (“Terms”) apply to your use of the ARKE Chocolatier website and any purchases made through it. By accessing our website or placing an order, you agree to these Terms.

1) About us

ARKE Chocolatier (“we”, “us”, “our”) is a small-batch confectionery business based in Australia, offering handmade chocolate-covered filled dates and Dubai-style chocolate bars.

2) Eligibility & personal use

By placing an order, you confirm that:

  • you are at least 18 years old (or have permission from a parent/guardian), and
  • you are legally able to enter into a binding agreement.

Purchases are for personal use or gifting, unless otherwise agreed for corporate/bulk orders.

3) Products & availability

  • Our products are handmade in small batches. As a result, availability may be limited, and products may sell out without notice.
  • We reserve the right to change, discontinue, or update products, packaging, sizes, flavours, and ingredients at any time.
  • Product photos are for presentation purposes. Because items are handmade, minor variations may occur.

4) Pricing & payment

  • All prices are listed in AUD unless stated otherwise.
  • Prices may change without notice.
  • Payment must be completed at checkout before an order is processed.
  • If a pricing or listing error occurs, we may cancel the order and refund any amount paid.

5) Orders, processing & acceptance

  • After you place an order, you will receive an order confirmation. This does not guarantee acceptance.
  • We reserve the right to accept or decline an order (for example: stock limitations, suspected fraud, address issues, or system errors).
  • If we cancel your order, we will refund any amount paid.

6) Shipping, delivery & risk

  • Shipping options and fees are shown at checkout.
  • Delivery timeframes are estimates only and may be affected by courier delays, peak seasons, weather, or public holidays.
  • Risk passes to you once the order is delivered to the address provided.
  • If you request or select Authority to Leave (ATL), you accept responsibility for any loss, theft, or damage after delivery.

7) Storage & product care

Chocolate is sensitive to temperature. You are responsible for:

  • ensuring the delivery address is suitable to receive perishable items, and
  • storing products correctly on arrival (cool, dry conditions; refrigeration recommended in warm weather).

8) Allergens & dietary information

Our products may contain or come into contact with common allergens including (but not limited to) nuts, dairy, gluten, soy, and sesame.

  • Ingredient and allergen information is provided on product pages where possible.
  • We do not guarantee a completely allergen-free environment.
  • If you have allergies or dietary requirements, please contact us before ordering.

9) Returns, refunds & Australian Consumer Law

Due to the nature of our products, we generally do not offer change-of-mind returns.

However, our goods come with guarantees that cannot be excluded under Australian Consumer Law. You may be entitled to a replacement or refund for a major failure, and compensation for other reasonably foreseeable loss or damage.

10) Promotions, discount codes & gift cards

  • Discount codes may be subject to conditions (expiry, minimum spend, exclusions) and may be withdrawn at any time.
  • Unless stated otherwise, only one discount code can be used per order.
  • Gift cards (if offered) are non-refundable and must be used in accordance with the conditions displayed at purchase.

11) Corporate & bulk orders

Corporate, bulk, custom, and event orders may have:

  • different lead times,
  • different cancellation terms,
  • and customised packaging arrangements.

These will be confirmed in writing at the time of booking/ordering.

12) Intellectual property

All content on this website—including text, images, logos, product names, and designs—is owned by or licensed to ARKE Chocolatier.

You must not copy, reproduce, distribute, or use our content for commercial purposes without written permission.

13) Website use & prohibited conduct

You agree not to:

  • misuse the website,

15) Limitation of liability

To the maximum extent permitted by law:

  • we are not liable for indirect or consequential loss (including loss of profit) arising from use of our website or products,
